Terms of Service
The agreement between you and Last Leg Jet for using the marketplace to find and book empty leg charter flights operated by independent, licensed air operators.
1. About these terms
These Terms of Service ("Terms") govern your access to and use of the Last Leg Jet website, mobile applications and related services (together, the "Platform"). The Platform is operated by Last Leg Jet Pty Ltd ("Last Leg Jet", "we", "us"). By creating an account, searching for flights or placing a booking you agree to these Terms, our Privacy Policy and our Charter Broker Disclosures.
If you are using the Platform on behalf of a company or other legal entity (for example as an operator administrator), you confirm that you have authority to bind that entity and "you" includes that entity.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), the Consumer Guarantees Act 1993 (NZ), the Fair Trading Act 1986 (NZ) or any other applicable law that cannot lawfully be excluded.
2. Last Leg Jet is a marketplace, not an air carrier
Last Leg Jet is an online marketplace and booking agent. We do not own or operate aircraft, employ flight crew or hold an Air Operator's Certificate (AOC). Every flight listed on the Platform is operated by an independent air operator (the "Operator") under the Operator's own AOC issued by the Civil Aviation Safety Authority (Australia), the Civil Aviation Authority of New Zealand, or the equivalent national regulator shown on the listing.
When you book a flight, you enter into a contract of carriage directly with the Operator. Last Leg Jet arranges that contract as your agent, collects payment on the Operator's behalf and passes the fare to the Operator after commission. Last Leg Jet is not a party to the contract of carriage and is not responsible for the operation of the flight.
The Operator's legal name, regulator, AOC status and aircraft details are displayed on every listing before you pay. Please review them, and our Charter Broker Disclosures, before booking.
3. Accounts and eligibility
You must be at least 18 years old and able to enter into a legally binding contract to create an account. You are responsible for keeping your password confidential and for all activity under your account. Tell us immediately at the contact address below if you believe your account has been compromised.
We may ask you to verify your email address, and may offer or require two-factor authentication (for example for operator and administrator accounts). Operator accounts must be verified before listings appear in search.
4. Listings, pricing and no markup
Operators set the price of each empty leg listing. The price shown on a listing is the Operator's price. Last Leg Jet does not add a markup to the fare: our commission is deducted from the amount paid to the Operator, not added to the price you see.
Your booking total is made up of the Operator's base fare, any applicable taxes and government charges, and a clearly itemised service fee where one applies. The complete total is shown before you confirm payment.
Empty leg flights exist because an aircraft is already scheduled to fly a sector, usually empty. Their schedule depends on the originating trip. Departure times, routing and aircraft may change, and a flight may be cancelled by the Operator if the originating trip changes. See the Refunds section for what happens in that case.
5. Booking process and 15-minute holds
When you select a flight and a number of passengers, the Platform places a hold on those seats for 15 minutes and shows a countdown. The hold reserves the seats while you complete payment. If payment is not completed within 15 minutes the hold expires automatically, the seats are released and no charge is made.
A booking is confirmed only when your payment has succeeded and you see the confirmation page and receive a booking reference beginning "LLJ-". Until then no contract of carriage exists.
Passenger names, contact details and any information required by the Operator or by law (for example identification for security screening) must be provided accurately and by the deadline shown in your confirmation.
6. Payment methods
We accept the payment methods shown at checkout for your booking currency. These may include credit and debit cards, PayPal, Klarna (where offered) and selected cryptocurrencies (BTC, ETH, USDC and USDT). Payment processing is performed by our payment providers; Last Leg Jet does not store full card numbers.
Cryptocurrency payments are quoted at a rate locked for 15 minutes. If the network transfer is not detected before the rate lock expires the charge lapses, the hold is released and any funds received late will be returned to the sending address, less network fees, after confirmation. Cryptocurrency refunds are made in the original asset at the originally locked amount.
Buy-now-pay-later services such as Klarna are provided by the relevant provider under that provider's own terms. Any instalment arrangement is between you and that provider.
7. Cancellations and refunds
Operator cancellation. If the Operator cancels a confirmed flight for any reason, including a change to the originating trip, weather or operational requirements, you will receive a full refund of everything you paid, including taxes and any service fee, to your original payment method. Refunds are initiated within two business days of the cancellation; your bank or provider may take longer to display the credit.
Customer cancellation. Because empty leg seats are perishable, bookings cancelled by you are non-refundable unless the listing states otherwise, or the Operator agrees in writing to a refund, or you have a right to a refund under applicable consumer law. Where a partial refund is agreed, any refund of the service fee is at our discretion.
Expired holds. A hold that expires unpaid is not a booking and is never charged.
Failed or disputed payments. If a payment fails after a confirmation has been issued (for example a reversed card payment), the Operator may treat the booking as cancelled. If you believe a charge is incorrect, contact us before raising a dispute with your bank so that we can resolve it quickly.
Nothing in this section limits your rights under the Australian Consumer Law or New Zealand consumer law, including the right to a remedy where a service is not provided with due care and skill or is not fit for purpose.
8. Operator obligations
Operators must hold a current AOC and appropriate insurance, must keep their compliance documents on the Platform current, and must only list aircraft and crew that are authorised under their AOC. Listings must be accurate. Operators are solely responsible for the safe conduct of each flight, for compliance with aviation, customs, immigration and safety laws, and for providing the service described in the listing.
Last Leg Jet reviews Operator documents before verification and periodically thereafter, but this review is limited to checking that documents have been supplied and appear current. It is not a safety audit and does not make Last Leg Jet responsible for the Operator's compliance.
9. Acceptable use
You agree not to:
- use the Platform for any unlawful purpose or in breach of any applicable law or regulation;
- make bookings you do not intend to honour, or interfere with holds in order to block seats;
- scrape, copy or republish listings or other content other than for your personal, non-commercial use;
- attempt to access other users' accounts or the Platform's infrastructure without authorisation;
- upload material that is false, defamatory, infringing or contains malicious code.
10. Liability
The Operator, not Last Leg Jet, is responsible for the carriage of passengers and baggage, including any delay, cancellation, injury, loss or damage occurring in connection with a flight. The Operator's liability may be governed by the Civil Aviation (Carriers' Liability) Act 1959 (Cth), the Civil Aviation Act 1990 (NZ) and applicable international conventions.
To the maximum extent permitted by law, Last Leg Jet's total liability to you arising out of or in connection with the Platform is limited to the service fee you paid to Last Leg Jet on the relevant booking, or where no service fee was charged, AUD 100. Where a consumer guarantee applies that cannot be excluded, our liability for a failure to comply with that guarantee is limited, where permitted, to resupplying the service or paying the cost of resupply.
We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded by law.
11. Intellectual property and content
The Platform, its design, software, text and brand imagery are owned by or licensed to Last Leg Jet. Operators retain ownership of the content they upload but grant us a worldwide, royalty-free licence to display it on the Platform and in related marketing for as long as the listing is live.
12. Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of these Terms. In particular, the personal details of passengers on a booking are shared with the Operator so that it can perform the flight.
13. Changes, suspension and termination
We may update these Terms from time to time. The date at the top of this page shows when they were last changed; material changes will be notified by email or a notice on the Platform before they take effect. Continued use after that date is acceptance of the updated Terms.
We may suspend or close accounts that breach these Terms, and Operators may be suspended where compliance documents lapse. You may close your account at any time by contacting us; confirmed bookings remain subject to these Terms.
14. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales. If you are a consumer resident in New Zealand, nothing in this clause prevents you from relying on New Zealand consumer protection law or bringing proceedings in New Zealand.
If you have a complaint, please contact us first at the address below. We aim to acknowledge complaints within two business days and resolve them within ten. Disputes about a flight itself will be referred to the Operator, and we will assist in that process.
